Terms of Service

The agreement for using the MarsCompute website, console and API. Version 2026-10.

Effective 9 October 2026.

1. The agreement

These terms are an agreement between you and MarsCompute Inc. (“MarsCompute”, “we”). They cover this website, the console and the API, together “the service”.

You accept them when you request access, sign in or call the API. If you use the service for an organisation, you accept them for that organisation and confirm that you may do so; “you” then means the organisation.

Our Privacy Policy explains how we handle data and is part of this agreement.

2. The service

  • The service gives you access to language models through one API. The models, their limits and their prices are listed on the Models and Pricing pages.
  • Every model runs on GPU servers that we operate.
  • We may add, change or retire a model. When we retire one, we tell you in advance whenever we reasonably can.

3. Accounts

  • Access is by application. We may accept or decline an application.
  • The information you give us must be accurate, and you must be at least 18.
  • You are responsible for the members you invite to your workspace and for what they do there.

4. API keys

  • Each key works for one model.
  • Keep keys secret. Do not publish them or put them in software that runs on your users’ devices.
  • You are responsible for every request made with your keys, until you revoke them.
  • If you think a key has leaked, revoke it in the console at once and tell us.

5. Acceptable use

You must not use the service to:

  • break the law or infringe anyone’s rights;
  • harm, exploit or endanger children;
  • harass, threaten or defraud people, or send spam;
  • create or spread malware, or attack any system or network;
  • get around rate limits, spending limits or access controls, or probe the service for weaknesses without our written permission;
  • use a model in a way that its licence forbids.

We may suspend access that breaks these rules.

6. Your content

  • What you send to a model and what it returns are yours. We claim no rights in either.
  • We use them only to provide the service. We do not train on them and we do not store them.
  • You are responsible for having the right to send what you send, and for how you use what comes back.
  • Model output can be wrong, incomplete, or similar to what another customer receives. Check it before you rely on it. It is not professional advice.

7. Fees and payment

  • You pay for the tokens your requests use, at the price on the Pricing page when each request is made. There is no subscription and no minimum.
  • Prices are in US dollars and exclude taxes. We add the taxes that apply to your billing address.
  • We may change a price. A change applies only to requests made after it is published.
  • A request that fails before the model returns a response is not charged.
  • Usage for each calendar month, counted in UTC, is invoiced after the month ends and charged through Stripe to the payment method on your workspace.
  • Your spending limit is checked before each request. A request that would pass the limit is refused.
  • If a payment fails, you have three days to fix it. After that we may suspend API access until every open invoice is paid.
  • If you think an invoice is wrong, tell us at [email protected] within 30 days of receiving it.

8. Availability and limits

  • Each model has limits on requests per minute and on requests running at once. Requests over a limit are refused.
  • We work to keep the service available, but we do not promise that it, or any model, will be available at all times.
  • We may interrupt the service for maintenance or to protect it.

9. Suspension and ending

  • You may stop using the service at any time. To close your workspace, write to [email protected].
  • We may suspend or end your access if you break these terms, do not pay, or put the service or other customers at risk, or if the law requires it.
  • If we stop offering the service, we tell you in advance.
  • Fees for usage up to the end remain due. Sections 6 and 10 to 16 continue to apply afterwards.

10. What is ours

The service, this website and the MarsCompute name belong to us or to those who license them to us. These terms give you the right to use the service and nothing more. If you send us suggestions, we may use them without owing you anything.

11. No warranties

The service is provided as it is and as available. To the extent the law allows, we give no warranties, including about accuracy, fitness for a particular purpose, or uninterrupted operation.

12. Limit of liability

  • To the extent the law allows, neither of us is liable to the other for lost profits, lost revenue, lost data, or indirect or consequential loss.
  • Our total liability to you for everything connected with the service is limited to the fees you paid us in the twelve months before the event that gave rise to the claim, or 100 US dollars if that is more.
  • Nothing in these terms limits liability that the law does not allow to be limited.

13. Claims caused by your use

If someone brings a claim against us because of what you sent to the service, how you used its output, or your breach of these terms, you will cover our reasonable costs and losses from that claim.

14. Changes to these terms

We may change these terms. For a change that matters, we email account holders at least 14 days before it takes effect. If you keep using the service after that, you accept the change.

15. Governing law

These terms are governed by the laws of the State of Delaware, United States, without regard to its rules on conflicts of law. The state and federal courts located in Delaware have exclusive jurisdiction over any dispute about them or the service.

16. General

  • These terms, the Privacy Policy and the prices on the Pricing page are the whole agreement between us about the service.
  • If part of these terms cannot be enforced, the rest still applies.
  • If we do not enforce a term at once, we may still enforce it later.
  • You may not transfer this agreement without our written consent. We may transfer it as part of a merger or sale of the business.
